HK Bus Route End User License Agreement

This End User License Agreement (“Agreement” or “EULA”) is a binding legal agreement between you (the “User” or “you”) and the HKBusRoute Development Team (“we”, “us”, or “our”) governing your use of the HKBusRoute mobile application for iOS devices (the “Application”).

By downloading, installing, or using the Application, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not download, install, or use the Application.

You acknowledge that this Agreement is concluded between you and us only, and not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the Application and the content thereof.

1. Scope of License

We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited license to run and use the Application on any Apple-branded products running iOS that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms of Service.

You may not:

  • Decompile, reverse engineer, disassemble, or attempt to derive the source code of the Application.
  • Modify, adapt, improve, or create derivative works from the Application.
  • Rent, lease, loan, sell, sublicense, or distribute the Application to any third party.

2. Transit Data & ETA Disclaimer (Crucial Notice)

  • Source of Data: The Application aggregates real-time Estimated Time of Arrival (ETA) and route data from public APIs, including the Hong Kong Governmentโ€™s “DATA.GOV.HK” portal, KMB, Citybus, MTR, and other public transport operators.
  • No Warranty of Accuracy: All transit data and smart notifications are provided “as is” and “as available” for reference only. Actual arrival times fluctuate due to live traffic conditions, weather, road accidents, or technical delays from the transit operators.
  • Limitation of Liability: We do not guarantee that the schedules, route maps, or ETA alerts are 100% accurate or continuous. We shall not be held liable for any missed trips, delays, financial losses, or inconveniences caused by data inaccuracies or network outages.

3. Pro Member Subscription & Auto-Renewal Rules

The Application offers a “Pro Member” tier via In-App Purchases (subscriptions).

  • Billing & Renewal: Subscriptions automatically renew at the price and frequency selected at the time of purchase unless auto-renew is turned off at least 24 hours before the end of the current billing cycle.
  • Payment Processing: Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions must be managed and cancelled by you directly through your Apple ID Account Settings.
  • Refunds: All monetary transactions are handled entirely by Apple. We cannot directly issue refunds for App Store purchases.

4. Maintenance and Support

We are solely responsible for providing any maintenance and support services for the Application. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

5. Privacy and Location Data

To provide features like the interactive map, nearby bus stop searches, and smart walking reminders, the Application requires access to your deviceโ€™s GPS location.

  • Your location data is processed locally on your device to calculate distances and is never uploaded or sold to external servers.

6. Intellectual Property Rights

You acknowledge that in the event of any third-party claim that the Application or your possession and use of the Application infringes that third partyโ€™s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

You may not use or otherwise export or re-export the Application except as authorized by United States law and the laws of the jurisdiction in which the Application was obtained. In particular, but without limitation, the Application may not be exported or re-exported:

  1. Into any U.S.-embargoed countries; or
  2. To anyone on the U.S. Treasury Department’s Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List.

By using the Application, you represent and warrant that you are not located in any such country or on any such list. You also agree that you will not use these products for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture, or production of nuclear, missile, or chemical or biological weapons.

9. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Application (e.g., you must not violate your wireless data service agreement or home internet terms of service when using the Application’s live updating features).

10. Third-Party Beneficiary

You acknowledge and agree that Apple, and Appleโ€™s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

11. Governing Law

This Agreement and your relationship with HKBusRoute under this Agreement shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR).
